What data we process

We only process the personal data we actually need for the relevant activity. This typically includes:

• Contact data (name, address, email address, telephone number) that you provide via our contact channels, by email or by phone.
• Order data (items purchased, delivery and billing address, order date, order number) when you place an order in our shop.
• Payment data needed to process your payment. Card and Twint details are processed exclusively by our payment provider Stripe and are not visible to us in plain text.
• Technical access data such as IP address, request date and time, browser type, operating system and referrer, to the extent required to deliver the website.
• Data relating to repair, digitisation or restoration that you hand over to us together with your device or media.

Purposes of processing

We process your data for the following purposes:

• Handling enquiries, mandates and orders.
• Communicating with customers in the course of an ongoing job.
• Meeting statutory retention and bookkeeping obligations.
• Detecting and preventing fraud, abuse and attacks against our systems.
• Improving and securely operating our website.
• Where the law permits, pursuing legitimate interests, in particular the assertion and defence of legal claims.

Legal bases

Depending on the situation, we rely on the following legal bases when processing your personal data:

• Performance of contract and pre-contractual measures, in particular when processing your order or repair request.
• Legal obligations, in particular under the Swiss Code of Obligations, VAT law and federal accounting legislation.
• Legitimate interests, especially in a secure and well-functioning online presence and in the assertion and defence of legal claims.
• Your consent, where we expressly ask for it – for example for voluntary newsletter sign-ups, should we offer them.

Recipients and processors

We only share your data where this is necessary to deliver the service you have requested or where we are legally obliged to do so. We regularly work with the following processors:

• Stripe (Stripe Payments Europe Ltd., Dublin / Stripe Inc., USA) – payment processing in the shop.
• Vercel Inc., USA – hosting and delivery of the website.
• Sanity Inc., USA – content management system and media delivery.
• Resend Inc., USA – sending transactional emails such as order confirmations.
• Swiss Post and other shipping providers we engage – delivery within Switzerland and Liechtenstein.
• Accounting, audit and advisory firms, to the extent required to meet our legal obligations.
• Authorities and courts, where we are legally required to disclose or where this is necessary to defend our rights.

Cross-border data transfers

Some of the providers above are based or operate servers in the United States of America. We only transfer personal data to such countries where an adequate level of protection is ensured – for example, by certification under the Swiss-US Data Privacy Framework, by EU Standard Contractual Clauses, or with the data subject's consent.

On request, we will provide further information about the safeguards in place.

Retention periods

We retain personal data only for as long as necessary for the stated purposes or as required by statutory retention periods.

Order data and accounting documents are retained for ten years in line with the bookkeeping obligations under Art. 958f of the Swiss Code of Obligations. Enquiries via our contact channels are deleted after they have been dealt with, unless contractual or legal obligations require longer retention.

Your rights

Vis-à-vis Enter Classic Technics AG you have, in particular, the following rights:

• Right of access: to learn whether and which personal data we process about you.
• Right to rectification of inaccurate personal data.
• Right to erasure of your personal data, subject to any legal or contractual retention obligations.
• Right to restriction of processing in the cases provided for by law.
• Right to object to processing on grounds relating to your particular situation.
• Right to data portability for data you have provided to us yourself, where the legal conditions are met.
• Right to withdraw consent previously given, with effect for the future.

How to exercise your rights

To exercise your rights, an informal email to info@ect.ch is enough. Please tell us which right you wish to exercise and, where needed to protect your data, attach suitable proof of identity.

Cookies and performance telemetry

We use cookies and comparable storage technologies only where technically necessary to operate the site, for example to manage the shopping cart.

To monitor the technical performance of the site we use Vercel Speed Insights, which collects anonymised load-time metrics. We do not use advertising or tracking pixels and do not build marketing profiles.

You can restrict or block cookies in your browser. Please note that some functions of our site – in particular the shopping cart – may then no longer be fully usable.

Contact by email or phone

When you contact us by email, by phone or via a contact form, we store the information you provide (name, contact details, content of the enquiry) in order to respond to your enquiry and document the subsequent communication. The legal basis is the performance of pre-contractual measures or our legitimate interest in proper handling of the work.

We retain enquiries and the related correspondence as long as needed to deal with them and, at the latest, as long as retention obligations or legal claims arising from the contact may still apply.

Repair and digitisation work

When you hand over a device or media for repair, digitisation or restoration, we may become aware of personal content – private audio or video recordings, data stored on computers, or addresses on devices, for example.

We treat such content strictly confidentially. Our team is bound by an obligation of secrecy. We only view content insofar as necessary to carry out the work. On request, we will sign a separate confidentiality agreement with you.

Once the work is complete, we return your data and devices. Any copies on our work stations are securely deleted after an appropriate period – typically three months, unless warranty claims require otherwise.

Automated decisions

We do not use automated decision-making within the meaning of Art. 22 GDPR or Art. 21 revFADP that produces legal effects concerning you or significantly affects you in a comparable way. Decisions about repairs, quotations and deliveries are taken manually and in a way that can be traced.

Data security

We take appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, misuse or alteration. Data transmission over the internet uses encrypted connections (TLS). Absolute security cannot, however, be guaranteed given the technical nature of the internet.

Right to lodge a complaint

You have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC) if you believe that the processing of your personal data infringes applicable law. Contact details are available at www.edoeb.admin.ch.

Where the GDPR applies, you may also lodge a complaint with a competent European supervisory authority.

Changes to this policy

We reserve the right to update this privacy policy at any time to reflect changes in the law or in our practices. The current version is always available at ect.ch/legal/datenschutz.
